We at Auric Law Partner, are competent to assist our clients with the legal as well as regulatory issues pertaining to mining. The lawyers at the Firm have advised on mining laws and various aspects in the mining sector such as bidding, acquisition, development, financing, construction, operations, etc.

Our team consists of a team of professionals well versed with mining laws in India, which include, but are not limited to the Mines Act, 1952; Mines and Minerals (Development and Regulation) Act, 1957; the Mines Rules, 1955; Mines Rescue Rules, 1985; Coal Mines (Special Provisions) Act, 2015; Coal Mines Regulations, 1957; The Oil Mines Regulations, 1984; The Minor Mineral Concession Rules, 1960; Offshore Areas Mineral (Development and Regulation) Act, 2002. We can strategically advise our clients, which include private and public sector companies, as well as foreign companies on different ventures.

Services rendered by us include:

  • Negotiating, drafting and reviewing agreements, assisting our clients with bidding for energy projects, evaluation and finalization of bids from project developers, setting up of greenfield projects, risk management, etc.
  • Providing advice and assistance to our clients on joint ventures for coal mining projects, coal import and marketing agreements, leasing agreements for mining and quarrying, sub-contracting agreements, exploration agreements, drilling and coring agreements, development and operation agreements, coal supply agreements, drilling contracts, etc. In addition to drafting and vetting mining agreements.
  • Assisting our clients in the regulatory aspects of mining laws and regulations, which include reconnaissance permits, mining leases and prospecting license, land use authorizations, liasoning with government authorities and several other consents and approvals.
  • Conducting due diligence for mergers and acquisitions in the mining sector.
  • Ensuring that our clients’ operations are in compliance with the existing laws and regulations, including those pertaining to mining disclosure, environmental standards and mineral and surface rights.
  • Provide assistance related to the transfer, sale or acquisition of mining properties, processing facilities, guidance on financing projects, as well as corporate and taxation issues and provide them with the best possible way of structuring their operations.
  • Assisting our clients with day-to-day operations as well as complex regulations and litigations.
  • Assisting our clients in compliance with the environmental regulations and ensuring that the use of hazardous materials in mining activities does not hamper the air and water quality. and
  • Providing comprehensive assistance to our clients in services such as financing and development of mining projects, processing, transportation, extraction, sale of non-ferrous and precious materials, etc.
